Detective costs incurred to prove serious misconduct that cannot otherwise be demonstrated may be reimbursable in proceedings concerning separation maintenance.

• Detective costs are reimbursable in maintenance proceedings if one partner conceals the amount of their income. OLG Zweibrücken, Ref. No. 6WF 117/00
• Even the fact, proven by detectives, that a person has moved into the same house constitutes clear evidence of a close relationship with a new partner. This is sufficient to assume a relationship equivalent to marriage and, in this case, releases the divorced husband from further maintenance payments to his ex-wife. OLG Frankfurt, Ref. No. 1 UF 94/01
• The Higher Regional Court of Koblenz ruled that the ex-wife must also reimburse her former husband for the costs of hiring a detective agency in the amount of approximately €7,000. After witness examinations failed to produce a clear result regarding whether the ex-wife was living in a non-marital partnership with a third party, the engagement of a detective was deemed necessary. The detective was able to establish that the ex-wife and her new partner were living together, which ultimately had a decisive influence on the ruling in favor of the ex-husband. In addition to the usual legal costs, the ex-wife therefore had to bear the detective costs in full, as these were necessary, directly related to the proceedings, and proportionate in relation to the maintenance payments expected over a longer period.
